For a compromise agreement to be binding an employee must obtain advice from someone who is a "Relevant Independent Adviser" or "Relevant Adviser" for purposes of the employment legislation which deals with compromise agreements. Although many employees look for a solicitor to provide this service barristers too are "Relevant Independent Advisers" for purposes of the employment legislation concerned with compromise agreements.

Compromise agreements

A compromise agreement in an employment case is a written agreement setlling employment claims. It can be an agreement under which an employee's employment is terminated; or an agreement which settles specific employment claims.

Compromise agreements are governed by Statute and require an employee to obtain advice from a "relevant independent adviser". These agreements apply to settlements of all types of statutory employment rights claims such as unfair dismissal, sex discrimination, race discrimination, disability discrimination, non-payment of wages, minimum wage claims, holidays and holiday pay claims and other statutory employment rights from time off for reasons such as maternity and paternity leave to issues about Sunday working.
